How to Open an ALF in Hernando County, Florida

If you are researching how to open an ALF in Hernando County, I would not begin with the AHCA application. I would begin with the property and ask a harder question: Can this exact building, at this exact address, support the ALF I intend to license?

Florida licensing law requires local zoning documentation plus satisfactory fire and sanitation inspections. In Hernando, those requirements meet the property early. Hernando Has Two Property Questions, Not One

The first question is whether the proposed ALF use is allowed. The second is whether the building is actually ready to be occupied for that use.

Hernando makes the first question unusually visible because its Zoning Division specifically lists Assisted Living Facility Review among its services. Planning also handles special exceptions, conditional uses, rezoning, and related development review. So "the zoning looks residential" is not an answer. Capacity, zoning district, land-use rules, and Florida's community residential home law can change the path.

Florida Statute 419.001 gives certain homes serving six or fewer residents residential-use protections when the statutory conditions are met. Outside that framework, do not assume the same treatment. Hernando has processed ALF and community-residential-home proposals through special-exception review. Ask Zoning what applies to this parcel, this capacity, and this operating model.

First, Find Out Which Government Has the Property

A Hernando County mailing address does not tell you who handles the building file.

Inside the City of Brooksville, the city Building Division handles permits and inspections. Brooksville tells applicants to use the Property Appraiser's levy code to confirm city jurisdiction. Outside the city, the Hernando County Building Division is the local permitting authority.

Fire is different. Since October 1, 2025, Hernando County Fire Rescue has provided fire and rescue services inside Brooksville too. A Brooksville ALF can therefore have city zoning and building questions while working with the county fire system. Settle that split before collecting approvals from the wrong office.

The Occupancy Permit Is Where the Paper Answer Meets the Building

Hernando still publishes its Occupancy Permit application. The guidance explains that the process tests whether a space meets zoning, building, and fire requirements for the specific business before a Certificate of Occupancy authorizes the use.

Carline's notes from an earlier Hernando filing show the practical side: the package she was assembling included the proposed use, site and floor plans, address verification, and the zoning approval letter. Her notes also contain an older email-submission route. Do not use that route today. Hernando launched Civic Access in March 2026.

The lesson is bigger than the old workflow. A zoning letter does not tell you what it will cost to make the building occupiable. Ask about occupancy, change of use, building work, accessibility, and corrections while you can still renegotiate or walk away.

Fire Review Can Change the Property Economics

Our Hernando file contains a direct exchange with Fire Prevention about a small group-home property. The response got down to bedroom egress, smoke alarms, extinguishers, and possible additional fire-alarm or sprinkler requirements for assisted living uses.

I would not design a 2026 facility from a 2025 email. Codes, occupancy classifications, and project facts matter. But the exchange shows how quickly fire review becomes a real estate issue. A window, exit path, alarm system, or sprinkler requirement can turn a "minor renovation" into a different budget.

Take the actual floor plan to the current fire authority before buying materials or moving walls. Florida law treats ALFs as residential board-and-care occupancies for fire-safety purposes, and local fire inspection is part of the licensing picture.

DOH-Hernando Will Look at More Than Cleanliness

When we asked DOH-Hernando for ALF-related forms in June 2025, Environmental Health told Carline to submit the Group Care Requirements form, a floor plan containing the required elements, the applicant section of the interagency water/sewage form, and water records.

The Hernando group-care material ties resident capacity to the floor plan, food-service setup, water source, and wastewater. Kitchen requirements become more involved as capacity rises. If the site uses septic, DOH-Hernando currently states that new installations, repairs, modifications, and approvals of existing systems require a local permit, with operating permits required for certain commercial systems.

A beautiful house can still be the wrong ALF property if the kitchen, sewage capacity, water source, or floor plan cannot support the operation you are planning.

Emergency Planning: Build It Early, File It at the Right Time

Hernando County publicly posts approved Emergency Power Plans for assisted living facilities, but its public page does not currently lay out a complete ALF-specific CEMP intake workflow.

The 2026 Florida Statutes require a licensee subject to CEMP requirements to submit the plan within 30 days after initial licensure and then annually, with additional submissions after significant modifications. Build the plan while developing the facility, but confirm Hernando's current intake method directly before filing rather than relying on an older process.

How I Would Sequence a Hernando County Deal

I would settle jurisdiction first and get a written answer on the proposed use and capacity before the property commitment becomes hard to unwind. Then I would test the building against occupancy, fire, floor-plan, water, kitchen, and septic realities before spending heavily on renovations. Only after those local questions are under control would I let the AHCA licensing file become the center of the project.

Before money becomes non-refundable, I would want clear answers to five things:

  • Which government controls zoning and building for this parcel?
  • Does the resident capacity change the zoning or special-exception path?
  • Will the ALF use trigger occupancy, change-of-use, building, or accessibility work?
  • Has Fire Prevention reviewed the actual floor plan early enough to affect the budget?
  • Can the kitchen, water source, and septic or sewer system support the intended capacity?

Better Due Diligence Makes a Better Hernando County ALF

Hernando is not difficult because it has one mysterious ALF rule. Problems arise when an owner treats zoning, occupancy, fire, health, and licensing as separate checkboxes instead of one property decision.
