Lee County is one of those places where saying "I am opening an ALF in Lee County" is not yet enough information to map the approval path. The exact address may place you in unincorporated Lee County or inside a municipality, under a particular zoning authority, within an independent fire district, on public utilities or private systems, and inside a specific evacuation or flood context.

If I were evaluating a Lee County property, I would treat the address as a regulatory map. Before I worried about furniture, staffing, or the AHCA survey, I would want to know which agencies control the property and what use and occupancy they believe I am proposing.

Start With Jurisdiction and the Correct Use Classification

For unincorporated property, Lee County Community Development handles zoning and building review through its Application & Information Center. The current Lee Plan states that facilities licensed under Rule 58A-5, including adult congregate living facilities, are treated as residential uses and limited to locations and densities appropriate for residences. That policy does not replace parcel-specific zoning review, but it is important context when discussing the proposed use with the county.

A zoning inquiry should identify the exact use, resident capacity, and operational model rather than relying on a broad label and assuming the label answers the code question. Get the zoning determination in writing before committing major money to the property.

A Residential Conversion Can Become a Commercial Alteration Project

Lee County's current Commercial Building Guide specifically includes "Hospital, ALF or Institutional Building" among commercial alteration and building-use options. In our property-specific Lee County work, the county has directed an ALF conversion into the commercial-alteration path rather than treating it as a simple residential change.

Do not assume that will be the exact permit type for every property. Do take the lesson seriously: a house becoming an ALF can trigger a different plan-review and occupancy conversation. Floor plans, sleeping rooms, accessibility, fire protection systems, electrical work, generators, plumbing, and other improvements may need to be coordinated through Community Development before final inspections.

Lee County Due Diligence Is Multi-Agency Due Diligence

A zoning answer is not a fire answer. A fire answer is not a septic answer. A county address is not automatically a county fire district. Map the agencies before you map the renovation budget.

Your Fire Authority May Be a Special District

Lee County's current fire-inspection instructions use a two-step process: generate the county fire-inspection ticket, then coordinate with the local fire department that serves the address. The county lists numerous separate fire districts, while Fort Myers and Cape Coral handle their own plan review, inspections, and permits.

DOH-Lee Group Care includes assisted living facilities within its Environmental Health program. Florida law requires a satisfactory county health sanitation inspection for initial ALF licensure.

In that correspondence, the county advised that food-service permitting could be triggered at a stated resident threshold and provided separate instructions for septic review and limited-use well water. Those details are valuable for property screening, but thresholds, fees, forms, and sampling instructions can change. Confirm the current requirements directly with DOH-Lee before filing or budgeting.

Lee County Has a Dedicated ALF Emergency-Plan Portal

Unlike counties where the ALF CEMP intake method is not clearly published, Lee County Emergency Management has a dedicated healthcare-facility process. The county states that CEMPs and EPPs are submitted through its Emergency Plans Upload Portal, and its current contact listing assigns assisted living facilities and ALF emergency-power plans to Michelle Rodgers.

That clarity helps, but it also means emergency planning should be treated as an active workstream. Build the CEMP, emergency power strategy, evacuation decisions, transportation arrangements, and supporting documents around the actual facility and location, not a generic template.

Business Tax Comes Later Than Many Owners Assume

The Lee County Tax Collector requires location and zoning information for a business tax account, but Florida law adds an important ALF-specific timing rule: a county or municipality may not issue the business tax receipt for operating an ALF until AHCA has licensed that facility at the specified location.

That matters because older working notes can suggest a different order. For a current project, use the statute and current local instructions, not an old checklist, to decide when the business tax receipt belongs in the sequence.

Flood and Evacuation Risk Belong in the Property Decision

Lee County is also a place where emergency-planning risk can affect the real estate decision. Community Development publishes current and future flood mapping resources, and Emergency Management maintains evacuation and flood-hazard information. Before committing to a property, understand the parcel's flood and evacuation context, emergency-power implications, and how residents would actually be moved or sheltered during a major storm.

Final Takeaway

Lee County is not one permitting counter. A successful ALF project may require the correct municipal or county land-use path, commercial building review, the correct fire district, DOH environmental-health approval, a dedicated county emergency-plan submission, and finally an AHCA file that matches all of it. The address controls the agencies, so the address needs to be understood before the investment is made.
