How to Open an ALF in Highlands County, Florida

Here, I want to focus on the Highlands County decisions that can make a property workable, expensive, or unusable before AHCA ever sees the file.
Highlands County Has an ALF-Specific Property Test
For an unincorporated property, do not stop when somebody tells you the zoning district. Read what the district requires for the actual use. In the county's Land Development Regulations, R-3 and R-3 NC include assisted living facilities, but they also attach site-specific criteria: access on or to a collector or arterial road, access to on-site or adjacent open space or proximity to a public park or recreation area, and central potable water and wastewater or an allowed equivalent.
That is a very different due-diligence conversation from asking whether a four-bedroom house has enough bedrooms. Road classification, utilities, sewage capacity, and the surrounding site can become part of the zoning analysis. The county's Development Review staff also reviews commercial site plans and concurrency for unincorporated development. Before you commit money, ask Planning and Zoning to identify the exact district, future land use, applicable ALF criteria, and whether site-plan, special-use, or other development review is required.
The City Limits Change the Approval Path
Highlands County includes Sebring, Avon Park, and Lake Placid, and the local approval path is not interchangeable among them. For unincorporated property, county Planning and Zoning, Building, and Engineering are the starting points, and Highlands now uses eTRAKiT for current planning, permit, and inspection activity.
Inside Sebring, the city maintains its own zoning ordinance and Building Department. Sebring's code is unusually important for resident capacity: a Type C group living facility, defined there as an assisted living facility serving 15 or more unrelated people, is conditional in several residential and mixed-use districts and subject to extra requirements in certain commercial or planned districts. In residential zoning, the code also applies a 1,500-foot separation rule to a Type C facility. In Sebring, changing the bed count can change the land-use strategy.
Avon Park and Lake Placid Use Hybrid Permitting
Avon Park and Lake Placid create another kind of jurisdiction issue. Avon Park requires the city's Planning and Zoning sign-off first, then sends the building permit to Highlands County for final processing. Lake Placid similarly requires town zoning and, when applicable, engineering approval before Highlands County Building issues the permit.
That means a county building permit is not proof that you have solved the municipal land-use question. Start with the city or town that controls the parcel, then map which approvals stay local and which move to the county.
Fire Review Is Countywide, and It Belongs Early
One part of the Highlands process is comparatively easier to identify. The Highlands County Fire Marshal states that the Fire Marshal and inspectors have jurisdiction for fire-safety matters throughout the county. The office reviews plans and specifications before building or installation permits are approved and conducts fire and life-safety inspections.
I would use that access early. If the floor plan needs fire-alarm work, protected exits, changes to doors, or other life-safety improvements, you want those facts while the project budget can still change. Waiting until the building looks finished is an expensive way to discover that the life-safety plan and the renovation plan were never aligned.
In Highlands, Water and Wastewater Are Real Estate Questions
Highlands has enough rural property that wells and septic cannot be treated as paperwork for later. The zoning criteria above already put water and wastewater into the ALF site conversation. DOH-Highlands Environmental Health separately handles group-care sanitation, food-hygiene plan review and inspections, and permitting and inspection of private and limited-use drinking-water systems.
On septic, the administrative structure has changed. DOH-Highlands notes that OSTDS is now under the Department of Environmental Protection, while DEP's current permitting guidance lists Highlands among the counties where applicants still submit OSTDS permit materials through the local county health department. Confirm the system capacity and current review path before assuming an existing septic tank can support the resident count, kitchen, staff, and wastewater load you intend to create.
Do Not Guess at the CEMP Submission Process
Florida's current ALF emergency-management rule requires each facility to maintain a comprehensive emergency management plan, coordinate with county Emergency Management, and submit the plan annually. The county emergency-management agency is the final administrative authority for the plan.
Highlands County publishes a general Emergency Management page, but I did not find a dedicated public ALF CEMP intake page that explains the current submission method, local checklist, or review queue. That is a place to call before you build a licensing timeline. The requirement is clear; the local intake workflow is not fully published.
How I Would Evaluate a Highlands County Property
I would get the jurisdiction and zoning answer in writing first, using the proposed resident capacity, not a vague description like "group home." Then I would test the parcel against road access, utilities, wastewater, site-plan requirements, building work, and fire review. Only after those property questions are under control would I let the AHCA initial licensing package drive the schedule.
Before money becomes difficult to recover, I would want five answers:
- Is the property unincorporated, in Sebring, in Avon Park, or in Lake Placid?
- What zoning category and resident capacity will the local government actually review?
- Do ALF-specific road, open-space, water, wastewater, separation, or site-plan rules apply?
- Can the building and fire plan support the intended operation without a surprise renovation budget?
- Who will review sanitation, drinking water, septic, and the CEMP, and what is the current submission method?
Choose the Highlands Property With the Approval Path in Mind
A Highlands County ALF can fail on a detail that does not show up in the real-estate listing: the wrong road, the wrong utility assumption, the wrong municipal process, or a resident count that changes the zoning treatment.
