How to Open an ALF in Hillsborough County, Florida

If you are looking at a Hillsborough County property for an assisted living facility, the county name alone does not tell you what approval path you are buying into. A Tampa address, a Plant City address, a Temple Terrace address, and a property in unincorporated Hillsborough can sit in the same county while answering to different zoning, building, and fire authorities.

This is one of those counties where I would not let the real-estate conversation get ahead of the regulatory one. Before I worry about the AHCA application, I want the exact jurisdiction, the proposed resident capacity, and a written land-use answer for that address. Those three facts can change the deal. Hillsborough Uses Resident Capacity as a Land-Use Issue

For unincorporated property, Hillsborough County's Land Development Code classifies Community Residential Homes as Type A, B, or C. Type A is limited to six placed residents, Type B to 14, and Type C is more than 14. The county also publishes a specific Local Zoning Form sign-off for community residential homes, which matters because Florida's initial ALF application requires documentation from the appropriate local government that zoning requirements have been met.

Capacity matters beyond the label. The county code applies separation standards to community residential homes, including a 1,000-foot separation for homes serving six or fewer residents. Type B and C homes are subject to a 1,200-foot separation from another Type B or C home and a 500-foot separation from areas of non-agricultural single-family zoning, with procedures for variances or waivers where applicable. When a Type B or C home requires a Special Use Permit, the county's application procedures call for a survey showing those surrounding uses.

That is why I would never underwrite a Hillsborough property based on "residential zoning" alone. The resident count and surrounding land uses can be part of the feasibility analysis.

Tampa Is Its Own Congregate-Living Conversation

Inside the City of Tampa, do not use the unincorporated county process as your roadmap. Tampa's Development Coordination Division maintains a separate Certification Letter for Congregate Living application. The current city materials require applicants to confirm that the use is allowed in the zoning district and document the proximity of other regulated group-living uses. The city's congregate-living materials also address Special Use 1 review where applicable.

The practical point is simple: identify the city limits before you ask whether the property "works." A county zoning sign-off is not a substitute for a City of Tampa determination, and the same principle applies in Plant City and Temple Terrace, which maintain their own planning and building functions.

The Building Has to Work After the Zoning Does

Once the land-use path is credible, I would turn immediately to the building and fire file. In unincorporated Hillsborough County, site development and building review can be required before construction, and Fire Marshal plan review is integrated with building permitting. The Hillsborough County Fire Marshal's jurisdiction is the unincorporated area, so a city property must be routed to the correct municipal authority.

Do not treat an existing house as automatically ready for ALF occupancy. A change in use or occupancy, renovation, alarm or sprinkler work, accessibility changes, egress, kitchen work, or other life-safety conditions can create a real capital budget. Tampa requires a Certificate of Occupancy when the occupancy classification changes, and Temple Terrace requires permitting when a building's occupancy changes. Solve that question before cosmetic renovation begins.

DOH-Hillsborough Adds Another Capacity Breakpoint

We have direct June 2025 correspondence with DOH-Hillsborough Environmental Health. When Carline asked for the local ALF forms, the department sent its group-care application, the Chapter 64E-12 group-care rules, and an existing septic-system evaluation packet. The response also directed well-water properties to the drinking-water program.

Current DOH-Hillsborough Group Care information still identifies assisted living facilities within the program, and the state Group Care guidance makes resident capacity important to food service. Facilities with 11 or more beds that serve food must obtain a food hygiene permit and submit plans for review before opening or operating. Hillsborough's application supplied to us likewise flags food-service plan review when capacity reaches 11 or more.

That threshold deserves attention while you are still evaluating the kitchen. If the property is on septic, DOH-Hillsborough currently publishes an Existing/Modification application package and septic evaluation forms. If it uses a well or limited-use water system, confirm the applicable drinking-water requirements before assuming the utility setup can support the proposed capacity.

Hillsborough's CEMP Process Is Public and Structured

Hillsborough County has a dedicated Health Care CEMP program and portal for regulated health-care facilities, including assisted living. The county publishes an ALF CEMP template, requires the applicable criteria outline, and includes Emergency Power Plan criteria in the ALF CEMP materials. Its published review-fee structure is tiered by bed count, another reason the intended capacity needs to be settled early.

I would build the emergency plan alongside the licensing and physical-plant work, not after everything else. Evacuation assumptions, emergency power, transportation, resident needs, and the facility's actual layout should all describe the same operation.

Before I Would Commit to the Property

I would want the jurisdiction confirmed in writing, the zoning path tested against the exact resident capacity, and any separation-distance problem identified before the deposit becomes difficult to recover. I would also want building and fire staff looking at the actual floor plan, not a verbal description of the house. Then I would resolve public sewer versus septic, public water versus well, food-service plan review, and the county CEMP process before setting an aggressive opening date.

Hillsborough is a large, sophisticated market, but that does not make the process interchangeable from one address to another. The strongest project is the one where the property, capacity, local jurisdiction, physical plant, Environmental Health file, emergency plan, and AHCA application have been agreed upon before money is spent in the wrong order.
