How to Open an ALF in Indian River County, Florida

Indian River County is one of those places where the address, resident capacity, and emergency-planning assumptions all need to be settled before I would call a property an ALF candidate. The county contains five incorporated municipalities, maintains a detailed zoning and development-review system for unincorporated land, and publishes unusually specific Environmental Health and CEMP guidance for assisted living facilities. That gives an operator useful information, but it also means there are several places to make an expensive assumption.

First, Find Out Whose Rules Apply to the Address

Indian River County itself tells property owners that if a project is inside a city or town, they should contact that local government. The county lists Fellsmere, Sebastian, Vero Beach, Indian River Shores, and Orchid as separate municipal jurisdictions. That is the first split in the process.

For unincorporated property, the County Planning Division handles zoning, site plans, plats, permits, and related development review. The county provides zoning maps and zoning-verification requests, and its code classifies uses as permitted, administrative-permit, or special-exception uses depending on the district. I would get the parcel-specific answer in writing rather than rely on a listing agent's description of the property.

Vero Beach shows why this matters. The city's current zoning tables expressly identify assisted living facilities in certain institutional and commercial districts. That is a different local framework from unincorporated county review, and the other municipalities should be treated the same way: independently, not as extensions of the county.

Capacity Changes the Health Department Path

DOH-Indian River publishes one of the clearest local explanations in this series. Its Residential Care and School Facilities page explains that assisted living facilities receive sanitation inspections and then divides residential food-service review by capacity.

Tier I facilities with five or fewer residents are not required to submit a food-service plan review. Tier II facilities with six to ten residents must submit a food-service plan review before opening or renovation, but do not receive a separate food-service permit. Tier III facilities with eleven or more residents must complete plan review and obtain a separate food-service permit.

That is not a detail I would postpone until the kitchen is finished. Resident capacity can change the Environmental Health file before opening, and the department also warns that an onsite sewage system may require modification when flow increases or ownership changes. A commercial kitchen can create additional OSTDS operating-permit issues. The property, resident count, kitchen design, and wastewater system need to be evaluated together.

Building and Fire Review Should Start With the Existing Structure

Indian River County Building Division uses MyGovernmentOnline for permitting and inspections. The county's Fire Prevention Bureau performs fire and life-safety inspections at commercial occupancies and state-licensed facilities and also provides site and commercial plan review for new and existing construction.

That combination is a reason to bring the actual floor plan into due diligence. A former residence, office, or other building may need change-of-occupancy work, accessibility upgrades, alarm or sprinkler modifications, egress corrections, or other life-safety improvements before it is ready for licensing. Indian River also reviews permits using the FEMA flood maps that became effective in 2023, so flood-zone and elevation issues belong in the property analysis, especially for coastal or low-lying sites.

Indian River Makes the Emergency-Planning Process Visible

Indian River County has a dedicated Health Care Facility Plan Review page with ALF CEMP criteria, Emergency Power Plan criteria, emergency environmental control-plan material, formatting suggestions, review hints, and common-error guidance. That is a useful signal: emergency planning is not something to tack onto the project after the building is complete.

For an ALF on the Treasure Coast, evacuation, transportation, emergency power, staffing, resident acuity, and the facility's flood and wind exposure should be tested against the actual site. A property can be physically attractive and still create an emergency-planning problem that deserves attention before the licensing calendar is promised to anyone.

The Better Indian River Due-Diligence Sequence

I would establish jurisdiction first, then obtain the zoning and land-use answer for the exact resident capacity. Next, I would test the existing building with Building and Fire, confirm the water and wastewater setup, and involve DOH-Indian River before kitchen or septic decisions are locked in. The CEMP and emergency-power work should develop alongside the physical-plant plan, not behind it.

Indian River County publishes more useful local information than many jurisdictions, but that does not make the process automatic. The value of the public guidance is that it lets an operator ask better questions before the property becomes an obligation.
