How to Open an ALF in Leon County, Florida

If you are looking at a house or other property for an assisted living facility in Leon County, the first question I would ask is not whether the address says Tallahassee. I would ask which government actually controls the property. A Tallahassee mailing address can sit inside the city or in unincorporated Leon County, and that distinction changes the zoning code, the review path, and the offices you need to deal with.

That is why I would not let an AHCA application become the first major investment in the project. In Leon County, the smarter opening move is to establish the jurisdiction, obtain a written land-use answer for the proposed resident count and operating model, and then test the building, utilities, fire/life-safety conditions, Environmental Health requirements, and emergency planning against the same property.

One Metro Area, Two Local Land-Use Paths

Unincorporated property runs through Leon County Development Services, which administers land-use and zoning review, site plans, subdivisions, concurrency, and Land Development Code interpretation. Property inside the City of Tallahassee follows the city zoning framework instead. The two governments coordinate in the broader Tallahassee-Leon planning environment, but an operator still needs the correct jurisdictional answer for the parcel.

Leon County currently offers both a Permitted Use Verification and a Letter of Zoning Verification. Its zoning-verification application expressly identifies a residential group home for six or fewer residents as a type of request. That is useful because it tells you the county has a written process for getting beyond a verbal 'it should be fine.' For an ALF, I would state the proposed licensed capacity, whether the property is existing residential construction, and the intended use clearly when requesting a determination.

Do Not Let a Residential Address Answer the Zoning Question

A property can look perfect for a six-bed home and still have conditions that matter to the project: zoning classification, future land use, prior approvals, legal use of the structure, parking, access, additions, or a change in occupancy. The county's own Leon County zoning FAQ tells property owners that zoning determines what development can occur. That is the level of due diligence an ALF buyer should apply before closing.

If the parcel is inside Tallahassee, use Tallahassee zoning information and city staff rather than assuming the county verification applies. This sounds basic, but jurisdiction mistakes create expensive delays because the operator may collect documents for the wrong process.

Environmental Health Is a Separate Workstream

Carline's June 2025 correspondence with the Florida Department of Health in Leon County is useful because the local office separated several issues instead of treating 'the health department' as one permit. The response pointed her to food safety and sanitation, residential group care, and biomedical-waste resources, while directing sewage and septic questions to the Florida Department of Environmental Protection.

That does not mean every ALF needs a biomedical-waste permit. It means you should identify which Environmental Health programs actually apply to the services and waste generated at your facility. Under the current statewide residential group-care framework, facilities with 11 or more beds have a separate food-hygiene permitting and plan-review obligation, while food hygiene for facilities with 10 or fewer beds is evaluated with the physical-plant inspection.

Building, Fire, and Utilities Should Be Tested Together

Once land use is supportable, the next question is whether the existing structure can legally and economically become the facility you are proposing. A residential floor plan, additions that were never permitted, inadequate egress, water or septic limitations, and fire-protection upgrades can change the deal before AHCA ever schedules a survey.

I would put the proposed resident capacity, floor plan, utility type, and existing occupancy history in front of the appropriate building and fire officials early. Do not renovate first and ask the code questions later.

Emergency Planning Is Part of the Operating Model

Florida ALFs must maintain a Comprehensive Emergency Management Plan and coordinate it with local emergency management. Leon County Emergency Management is the local agency to confirm the current healthcare-facility plan-review method. I did not find a clearly published Leon-specific ALF intake page that is detailed enough to substitute for direct confirmation, so the submission method, review expectations, and any local supporting documents should be verified before filing.

How I Would Underwrite a Leon County ALF Property

I would make the property earn the next dollar of investment. First, prove the jurisdiction. Second, obtain the land-use answer in writing for the actual capacity you plan to license. Third, confirm building and fire feasibility. Fourth, resolve public utilities versus septic/well questions and the Environmental Health lane. Then move the AHCA packet and emergency-planning work forward with a property that has survived local due diligence.

That sequence is not about slowing the project down. It is about avoiding the much slower problem of discovering, after closing or renovation, that the property and the business model do not line up.
