How to Open an ALF in Levy County, Florida
Oct 01, 2026Levy County is a good example of why I do not like asking only, 'Is an ALF allowed here?' The more useful question is, 'What local use is this facility going to be classified as at this capacity and on this parcel?' That distinction matters because Levy County's code has separate provisions for community residential homes and for assisted living facilities and nursing homes.
If planning staff places the project in the county's ALF category under Section 50-734, the site standards are substantial. If the project qualifies for a different residential-home classification under state and local law, the analysis can change. Before a buyer assumes that a six-bed home and a larger congregate ALF are interchangeable, I would get the classification in writing.
Classification Comes Before the Real Estate Decision
Levy County publishes a zoning use table and identifies uses as permitted, conditional, or special-exception uses. Its current Levy County conditional-use application separately lists community residential homes under Section 50-729 and assisted living facilities/nursing homes under Section 50-734. That is the clue: the county itself treats those uses differently.
For a small home, Florida's community-residential-home protections may be relevant depending on resident count, services, licensing category, and the facts of the operation. For a project that the county classifies as an ALF under Section 50-734, do not assume the small-home standards apply.
The County ALF Standard Is Not a Small-Site Standard
Current Levy County ALF standards state that an ALF or nursing home in that category must have a minimum 10-acre parcel, connect to municipal water and sewer, and keep structures at least 1,200 feet from any dwelling. The code also establishes density conversions for ALF units and congregate beds and requires the facility to maintain the applicable state license.
Those requirements can eliminate a property before you spend money on architectural plans. They also make utility availability a land-use issue, not merely an Environmental Health issue. A beautiful rural house on acreage with septic may still fail the specific county ALF standard if that is the classification assigned to the project.
Conditional Use Means Public Process and Timing
The county identifies Section 50-734 as a conditional-use category. That means the project is not simply a staff counter approval. Conditional use involves an application, staff review, public notice, and public hearings under the county process. I would build that timing and uncertainty into the acquisition contract rather than closing as though zoning were already settled.
Use Levy County zoning information to identify the zoning district and allowed-use table, then discuss the actual proposed capacity and facility model with Planning and Zoning before treating any parcel as viable.
Rural Infrastructure Still Has to Support Regulated Care
Levy County has large rural areas, so operators naturally look at properties with wells, septic systems, long driveways, and limited nearby infrastructure. The county's Section 50-734 municipal-water-and-sewer requirement makes that especially important for projects in the ALF category. For any smaller residential-home lane, separate utility and Environmental Health requirements still have to be confirmed.
Building and fire feasibility also belong in the early review. Distance from fire response, legal bedroom egress, accessibility work, electrical capacity, emergency power planning, and permitted additions can make a low-cost purchase expensive.
Emergency Planning Needs Local Coordination
Every Florida ALF needs a CEMP coordinated with local emergency management. Levy County Emergency Management is the county agency responsible for preparedness and response. Its public site does not provide a detailed ALF-specific submission workflow that I would rely on without confirmation, so ask for the current healthcare-facility plan-review method and required supporting documents before you are ready to submit.
The Levy County Due-Diligence Question
For Levy County, I would not write an offer around the sentence 'ALFs are allowed.' I would write the due-diligence plan around a specific resident count, a specific property, and a written local use classification. That one determination tells you whether you are dealing with community-residential-home rules, the county's much more demanding ALF standard, or another approval path.
That is the kind of answer that protects the business model before you inherit the property.
