How to Open an ALF in Palm Beach County, Florida
Oct 05, 2026Palm Beach County is one place where I would never give an ALF owner a single 'county zoning process' and send them on their way. The first question is jurisdiction: unincorporated Palm Beach County and its municipalities do not all use the same terminology, forms, or approval sequence.
I know that from working through real properties here. The mailing address is not the approval path, so identify the government that controls the parcel and use that jurisdiction's language before spending money on plans.
Unincorporated Palm Beach Has a Formal CRH/CLF Track
Palm Beach County's zoning resources maintain a dedicated Community Residential Housing process. The 2025 CRH instructions provided to my team required parcel and ownership documents, a justification statement, resident information, and a floor plan matching the Building Division record. That matters: if the house has been altered without permits, zoning review can stall before licensing gains traction.
The same instructions describe a sufficiency review followed by a provisional zoning confirmation, with a six-month window to provide the state license and a time-extension process available. Before using any deadline, form, or fee today, I would verify the live version on the county's Zoning Applications and Forms page.
The City Name Can Change the Vocabulary
Boca Raton is a good example. In correspondence on an actual property, city staff told my team that 'Assisted Living Facility' was not the right zoning terminology there; the request needed to be framed as a 'Residential Community Home.' Boca's current code still regulates community residential homes separately, including capacity and spacing rules.
Delray Beach has another system. Its current Community Residences page requires a zoning-verification form first, then a fuller application if the property qualifies, weighing resident count, parking, licensing, occupancy, proximity to another community residence, and whether conditional use or reasonable accommodation applies.
Boynton Beach's group-home packet also covers change of use, parking, life safety, and certificate-of-use. In Lake Park, a six-or-fewer-resident model follows a different path and separation requirement than larger proposals.
Palm Beach CEMP and Fire Review Need to Be Sequenced Correctly
Land-use jurisdiction may change by city, but Palm Beach County Emergency Management operates the healthcare CEMP review program for ALFs through its current Healthcare CEMP portal page.
The Palm Beach County Fire Rescue procedure provided to my team, effective February 12, 2026, adds a sequencing detail: for facilities under PBC Fire Rescue review, the fire plan is uploaded into the CEMP portal while still in draft, and fire-plan review is requested before the overall CEMP is submitted. I would not treat the two as unrelated tasks.
Environmental Health Still Tests the Real Building
DOH-Palm Beach correspondence sent to my team requested scaled floor plans, a site plan, water and sewer documentation, local building/zoning approval, fire information, and plan-review materials. Statewide food rules also change at 11 beds, requiring a separate food-hygiene permit and plan review.
My Palm Beach Rule: Identify the Jurisdiction Before You Fall in Love With the Property
For Palm Beach County, I would build a property file in this order: jurisdiction, exact local use terminology, resident capacity, spacing/proximity, building-record match, change-of-use and fire scope, Environmental Health, CEMP/fire-plan sequence, then AHCA licensing. The same house can have a very different future depending on which side of a municipal boundary it sits.
Treat the Six-Month Window as a Real Deadline
A provisional zoning confirmation feels like good news, and it is, but it also starts a clock. The instructions I saw gave the applicant six months to provide the state license or certification, with an extension process available. I would not count on the extension. Before you accept a provisional confirmation, map out how long AHCA licensing, the fire plan, Environmental Health, and the CEMP will realistically take on that property. If the honest answer is longer than six months, have that conversation with the county early rather than at month five.
Say It the Way the City Says It
Boca Raton told us 'assisted living facility' was not the right terminology for that site, and that is a lesson about vocabulary as much as zoning. Before you send any letter or application, read the city's own code and forms and borrow their terms. Describe the use the way they describe it, with the capacity and resident type stated plainly. If your request uses the wrong category, you may get a polite answer to a question you did not mean to ask, and then you lose weeks finding out why.
