How to Open an ALF in Polk County, Florida
Oct 05, 2026In Polk County, resident capacity is written into the land-use vocabulary. The county's current Land Development Code distinguishes a small group home with six or fewer residents, a large group home with seven to fourteen, and a group living facility with fifteen or more. That means the number of beds is not simply an AHCA decision. It can change the local review level.
I would settle that capacity question before choosing the property, especially in the fast-growing areas around Lakeland, Winter Haven, Davenport, and the I-4 corridor.
The Zoning Category Changes With Capacity
Polk's current Land Development Code uses different review codes depending on the land-use district and the size of the residential-care use. Small homes may receive a lower-level review in districts where a larger home needs a higher-level conditional process. Group living facilities of fifteen or more residents can move into another review tier again.
The county also amended its code in late 2025 to expand where large group homes can be considered in residential future-land-use districts. That is a good reason not to rely on an old zoning chart or someone else's approval. Pull the current code and get a parcel-specific answer.
Do Not Assume 'Residential' Means the Same Review Everywhere
Polk has multiple standard and special planning areas with their own use tables. A property that looks similar on the ground can sit in a different land-use district and trigger a different review code. Confirm the Future Land Use, zoning or special planning area, resident count, and whether the county classifies the proposal as a small group home, large group home, or group living facility.
Price the Conversion Before the Public Process
Before spending money on a conditional or higher-level review, I would have the property screened for building and fire feasibility. Bedrooms, exits, accessibility, parking, alarm/sprinkler work, electrical service, generator location, and utility capacity can make the project expensive even if the land-use path is available.
Environmental Health Still Follows the Bed Count
Statewide DOH rules make the food-service lane capacity-sensitive too. Ten or fewer beds stay within the residential group-care food framework, while eleven or more beds need a separate food-hygiene permit and plan review. That is another reason capacity needs to be established before the kitchen is remodeled.
Confirm the Current CEMP Intake With Polk Emergency Management
I did not find a current Polk public page detailed enough to publish a complete ALF CEMP submission workflow. Florida still requires local emergency-management coordination, so confirm the current reviewer, submission method, fire-plan documentation, fee, and timing directly before filing rather than copying a process from another county.
Lakeland, Winter Haven, and Davenport Run Their Own Process
The capacity-based review codes I just described apply to unincorporated Polk County. A property inside Lakeland, Winter Haven, Davenport, or another Polk municipality answers to that city's own zoning code, not the county's Land Development Code. I would not assume a county capacity threshold carries over to a city address, or that a city's small-home exemption matches the county's. Before you anchor a business plan to a specific bed count, confirm with the city directly whether the parcel is inside its limits and which code actually applies. That confirmation should come from the city itself, in writing, not from a real estate listing or a county employee speaking about a city process.
Ask Which Review Code Applies Before You Ask What It Costs
In Polk, the review code changes with the district and the size of the use, so the first question is not what the application costs. It is which review code your proposal triggers on that parcel. Ask planning to name it, and ask what the next tier up would look like if you ever expand. A six-bed home that grows to seven can land in a different process. I would rather know that before closing than discover it when a larger census starts to look attractive.
Do Not Trust a Chart That Predates the Amendment
The county changed its code in late 2025 to expand where large group homes can be considered in some residential future-land-use districts. That could help you, or it could make an older summary wrong in the other direction. Either way, anything written before the change deserves suspicion, including a broker's one-page zoning cheat sheet. Pull the current code, find the district, and ask staff to confirm how the amendment applies to the parcel. Then keep that answer in your file with the date next to it.
