Quick Answer: Duval County is not a simple county-permit process. Jacksonville operates as a consolidated city-county government, but the Beaches communities and Baldwin retain separate municipal functions. For a Jacksonville parcel, a use change can require both zoning approval and a Certificate of Use or Converting Use Building Permit through JAXEPICS. Jacksonville also has a very specific ALF CEMP submission package that includes the floor plan, annual passing JFRD fire inspection, shelter and transportation agreements, vehicle information, and emergency contacts.

Duval County is the most urban and process-heavy county in this five-county group. The advantage is that Jacksonville publishes far more detail online than many rural counties. The challenge is that applicants can easily confuse zoning approval, Certificate of Use, converting-use permits, fire review, Environmental Health, and AHCA licensing as though they were one approval. They are not.

Step 1: First Determine Whether the Parcel Is Under Jacksonville or a Separate Municipality

Jacksonville and Duval County are consolidated, but not every parcel follows one identical municipal development process. Atlantic Beach, Jacksonville Beach, Neptune Beach, and Baldwin retain municipal functions. Confirm the exact jurisdiction before using Jacksonville zoning forms or assuming JFRD and city building review will control every local approval.

Jacksonville Beach Planning and Development administers its own Land Development Code, zoning verification, conditional uses and permit tracking. An ALF applicant should never use a Jacksonville city process merely because the mailing address says Jacksonville or Duval County.

Step 2: In Jacksonville, a Change in Use Requires Zoning Review and Can Trigger a Certificate of Use

City of Jacksonville zoning guidance states that a Certificate of Use application is required for a change in the use of property. That is a critical distinction for ALF conversions. A property can be legal as a residence or prior business and still require a new use approval for assisted living.

Before filing, ask Current Planning to identify the exact land-use classification, whether the ALF is permitted in the zoning district, and whether a rezoning, exception, deviation or other zoning action is required. Do this before commissioning final construction plans.

Step 3: Jacksonville Uses a Converting-Use Building Permit Process for Existing Spaces

Jacksonville Certificate of Use and Converting Use guidance explains that the city reviews both Florida Building Code and Florida Fire Prevention Code compliance when a space changes use. The city currently publishes a review time of roughly 25 to 30 business days for a Certificate of Use "No Work" building permit.

Permit applications and plan packages are submitted through JAXEPICS and the Building Inspection Division. Jacksonville notes that plan sets are reviewed by multiple disciplines, including the Fire Marshal, and that mechanical, electrical, and plumbing scope should be clearly identified.

An ALF applicant should not wait until the end of the licensing process to discover that the city considers the project a different occupancy or requires additional life-safety, accessibility, plumbing, or electrical work.

Step 4: Jacksonville Fire Review Is Especially Important for Residential Conversions

Jacksonville Building Inspection small-business fire guidance states that an assisted living facility operated from a home must have a sprinkler system. The city also states that monitored fire alarm and sprinkler systems are required when those systems are installed and that routine annual fire-safety inspections are required.

Do not design the resident capacity first and fire protection second. Ask JFRD or the applicable municipal fire authority to evaluate the proposed occupancy, resident evacuation capability, sprinkler, alarm, monitoring, and egress requirements before the renovation budget is locked.

Step 5: DOH-Duval Requires Direct Group-Care Coordination

DOH-Duval Group Care Program states that assisted living and residential group-care facilities are inspected for construction, operation, and maintenance standards. The page directs new facilities to contact the Group Care Program for specific permitting instructions because requirements vary by facility type.

DOH-Duval also identifies food-service and other Environmental Health programs that can apply depending on the facility. Contact the office early enough that kitchen, laundry, restroom, water, wastewater, and physical-plant requirements can be reflected in the final plans rather than corrected after construction.

Step 6: Duval County Publishes a Detailed ALF CEMP Submission Package
