How to Open an ALF in Volusia County, Florida

Volusia County gives ALF buyers a clean number to pay attention to: six. The county's current zoning FAQ says up to six unrelated people can reside in a home without a special zoning permit, while more than six unrelated residents in a dwelling require special-exception approval from the County Council.

That does not mean every six-bed house is ALF-ready. It means the first land-use fork is easier to identify. After that, you still have to prove the building, fire, utilities, Environmental Health, emergency plan, and state licensing.

Six Residents Is the First Zoning Fork

Volusia County's current Zoning FAQ expressly addresses Community Residential Homes and the six-resident threshold. For a proposed facility above that size, I would assume the public special-exception process is part of the feasibility study until Planning confirms otherwise.

The county's current Zoning Information page also directs applicants to the Permit Guide and Connect Live system for parcel and permitting research.

Environmental Health Wants the Facility Designed Before Opening

The Volusia correspondence provided to my team said new facilities should submit health applications before construction and provide facility and kitchen floor plans plus a dietitian-signed menu. Municipal water and sewer simplified part of the documentation, while well or septic properties added another layer.

Several forms attached to that correspondence are older, so I would not use their old fees or septic instructions as current. The useful lesson is timing: Environmental Health should see the planned physical operation before the facility is built out.

CEMP Submission Includes Fire Approval

Volusia County has a dedicated Healthcare CEMP portal page that requires the CEMP and appendices to be uploaded electronically and includes the fire plan and fire marshal approval documentation. ALFs also have emergency-power-plan obligations.

I would make fire-plan approval and emergency-power documentation part of the same project schedule rather than treating the CEMP as a paperwork step after construction.

Municipal Volusia Addresses Need a Separate Jurisdiction Check

Daytona Beach, DeLand, Deltona, Port Orange, New Smyrna Beach, Ormond Beach, and other municipalities can have their own zoning and building processes. The county FAQ applies to unincorporated Volusia, so confirm the actual jurisdiction first.

Use the Public Hearing as a Planning Variable

If your model goes above six, I would treat the special-exception process as a real part of the schedule and the budget, not a formality. Public review means timing you do not fully control and an outcome you cannot promise anyone. So I would keep the purchase contract flexible, ask Planning what the process normally involves, and have a plan for what happens if the answer is slower or different than you hoped. A six-bed fallback, an extension, or a walk-away clause can turn a risky deal into a manageable one.

Bring a Real Menu to Environmental Health

The correspondence asked for facility and kitchen floor plans and a dietitian-signed menu, and that tells me how the office thinks. They want to see the operation, not a description of it. I would line up a dietitian early, design the kitchen around the menu rather than the other way around, and submit before construction. A kitchen built on guesswork is the kind of expense that gets torn out. The earlier those documents exist, the cheaper every later change becomes.

Check the City Before You Cite the County

The county FAQ speaks to unincorporated Volusia, and the list of cities is long. A property in Daytona Beach, DeLand, Deltona, or another municipality may follow different zoning and building rules, so the six-resident threshold I described may not carry over. Before you rely on it, confirm in writing which government controls the address. Then ask that office the same capacity question. It takes one call and one email, and it can keep you from building a plan on a rule that does not apply to your parcel.

Give Fire Approval Its Own Line on the Schedule

Because the CEMP portal wants fire-plan and fire-marshal approval documentation, I would give fire approval its own line on the project schedule. Ask early what the fire marshal needs to see, and keep the emergency-power documentation in the same folder. If the plan is waiting on a fire approval that is waiting on construction, the delay compounds. Treat it as a dependency from the first week, not a signature you collect when the paint dries.

My Volusia Rule: Six Is a Threshold, Not a Shortcut

A six-resident project may avoid one special-exception issue, but it still has to survive the physical-building and operating tests. I would use the threshold to choose the approval lane, not to skip due diligence.
